Frozberries is a shopping website where you can browse, select, and order products advertised on the Site from Frozberries. By accessing or using the Site, you agree to these terms and conditions. If you are under 18 years of age, you must obtain your parent or guardian’s consent before accessing and using the Site.


Compliance with the Terms & Conditions:


By completing your registration through the Site and using the Site to obtain Products from us, you agree to be bound by and comply with these terms and conditions.




Before placing an order for Products through the Site, you must complete the customer registration process through the Site. Any personal information that you provide will be held and used by us in accordance with our privacy policy. You may update, edit, or terminate your account at any time through the Site. Your account is non-transferable, and you may not have more than one active account. If you use a workplace email address for your account or to access the Site, you are solely responsible for ensuring that you comply with the rules, policies, or protocols that apply to the use of your email address and your workplace facilities.


Placing an Order for Products:


To order Products, select and submit your order through the Site in accordance with these terms and conditions. Any order you place through the Site for a Product is an offer by you to purchase the Product for the price notified (including delivery, other charges, and taxes) at the time you place the order. We may ask you to provide additional details or require you to confirm your details to process any orders placed through the Site. You agree to provide us with current, complete, and accurate details when asked to do so by the Site. We may call you to process your incomplete Order if all details are provided.



We currently accept credit card payments through our online store. If any items become unavailable, and you do not desire a substitute, they will be removed from your order, and a refund will be initiated.


Product Availability:


We understand that items you have ordered may become unavailable by the time your order is getting packed. In such cases, we will make every effort to contact you via email or phone to offer alternative options. To ensure we can communicate with you effectively, please leave clear directions in the comments section during checkout.


Product Quantities:


We strive to meet the needs of our retail customers; however, due to stock constraints, we may not be able to fulfill orders for larger quantities of specific items. If you plan to place an order for large quantities of specific items, please get in touch with us beforehand to avoid disappointment.


Frozen and Perishable Items:


We use Freezer Trucks for transportation and proper packaging to protect sensitive products during transit. However, we cannot offer guarantees for perishable and frozen products left unattended for extended periods of time if you are not available to collect them. Please ensure you are available to collect these items or arrange for someone to do so on your behalf.




We are committed to supporting our customers during these challenging times. If you have been diagnosed with COVID-19 or are experiencing flu-like symptoms, please comment ‘Self Isolating’ during checkout. We will do our best to accommodate your needs.


Our Online Store:


We are proud to offer a wide range of products on our online website and factory pick-up (by appointment), with dozens added each month. You can easily browse our products using the Product menu on the website or by using the search bar at the top of the page. To add comments/notes to your order, you can do that at check-out in your shopping cart.


Acceptance and Rejection of an Order:


We reserve the right to accept or reject any order placed for any reason, such as unavailability of the requested product, errors in the price or product description on the Site or in your order. Each order placed and accepted through the Site constitutes a separate binding agreement between us for the supply of those Products in accordance with these terms and conditions. We will notify you of any rejected order at the time you place it or within a reasonable time after submission.


Minimum and Maximum Amounts in Each Order:


To place an order within Sydney, the minimum purchase amount required currently is $70.00. For the Central Coast, the minimum purchase amount is $100. In Newcastle, the minimum purchase amount for each order is $150, and in Port Macquarie, the minimum purchase amount is $200. Additionally, please note that the delivery fees are determined based on the distance and suburb, and they do not include any processing or packing fees. Above minimum order value may change anytime with or without enough notice to customers.


Collection of Products:


You agree to comply with the collection requirements and other conditions that we notify you of when you place your order through the Site. These requirements may include photographic identification and a signature upon collection, as well as the presentation of the card used for payment. If someone other than you collects your order, they may be required to provide proof of identity, age, and the relevant card. Failure to provide appropriate identification or the relevant card may result in non-collection of the Products. We reserve the right to cancel your order if we suspect illegal transactions or breach of these terms, and we will contact you to confirm payment and information details.


Risk and Title:


The risk of the Products passes to you upon collection from Frozberries. The title of the Products passes to you upon the later of payment or collection.


Cancellation of an Order:


We may cancel any order, including those we have accepted, at any time without liability to you if the Products are unavailable, if there is a pricing or product description error on the Site, or if you have breached these terms and conditions. If we cancel your order, we will provide you with reasonable notice, and you will not be charged for the cancelled order. If any payment has been taken, the full payment amount, including the packing fee and other charges, will be refunded to your original payment method or through an alternative means. If you cancel an accepted order, we may charge you a cancellation fee of $20 or the costs to Frozberries arising from the cancellation plus the charges for any perishable Products ordered.


Fees and Charges:


We may charge you the purchase price of each ordered product, the packing fee, the cancellation fee, and any other applicable fees and charges. All fees and charges include GST where applicable and are in Australian dollars. The purchase price of each Product is shown on the product list on the Site at the time you place your order.




We aim to deliver your order within 0-4 working days from the date of your purchase as our standard delivery time for Sydney orders. However, please keep in mind that this is just an estimated duration, and unforeseen circumstances such as extreme weather or logistical problems might cause unexpected delays. Furthermore, the estimated delivery timeframe may vary depending on the distance of your suburb from Sydney. For instance, if you are located outside of 25kms of Sydney like in Wollongong, Central Coast, New Castle, or Port Macquarie, your order may take up to 7-14 days to be delivered. We appreciate your understanding and patience in such situations.
