Terms and Conditions

1. General

Frozberries is an e-commerce platform where you can browse, select, and order products directly through this website. By accessing or using any part of this website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you are under the age of 18, you must obtain consent from a parent or legal guardian before using the website. By proceeding with your visit or purchase, you represent that such consent has been obtained.

2. Compliance with the Terms & Conditions

By registering an account and utilizing the Site to purchase Products, you acknowledge and agree to be bound by these Terms and Conditions. Each order placed constitutes your continued acceptance of the most current version of these terms. We reserve the right to update these Terms and Conditions at any time, and continued use of the Site after such changes constitutes acceptance of the modified terms.

3. Registration

Before placing an order for Products through the Site, you must complete the customer registration process. Any personal information that you provide will be held and used by us in accordance with our Privacy Policy.

You may update, edit, or terminate your account at any time through the Site. Your account is non-transferable, and you may not have more than one active account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Placing an Order for Products

To order Products, select and submit your order through the Site in accordance with these Terms and Conditions. Any order you place through the Site for a Product is an offer by you to purchase the Product for the price notified (including delivery, other charges, and taxes) at the time you place the order.

We may ask you to provide additional details or require you to confirm your details to process any orders placed through the Site. You agree to provide us with current, complete, and accurate details when asked to do so by the Site.

5. Payment

We currently accept major credit cards and other payment methods made available at checkout. By completing your purchase, you authorize the processing of payment through our approved payment gateway(s). Frozberries does not store or hold full credit card information on our servers.

All prices displayed on the Site are in Australian dollars (AUD) and include GST where applicable. Payment must be received in full before your order is processed for delivery or collection. Delivery charges, handling fees, and other checkout fees are also shown inclusive of GST where applicable.

6. Product Availability

We understand that items you have ordered may become unavailable by the time your order is being packed. In such cases, we will make every effort to contact you via email or phone to offer alternative options or substitutes.

If you do not wish to receive a substitute product, the unavailable item will be removed from your order, and a refund for that portion of your purchase will be initiated to your original payment method.

7. Product Quantities

We try to meet the needs of our customers; however, in events of stock constraints, we may not be able to fulfill orders for larger quantities of specific items. If you plan to place an order for large quantities, please contact us beforehand.

8. Frozen and Perishable Items

We use refrigerated trucks for transportation. However, we cannot offer guarantees for perishable and frozen products left unattended if you are not available to collect them. Please ensure you are available at the time of delivery. We recommend that frozen items be transferred to appropriate storage immediately upon receipt. If perishable items are damaged or defrosted upon delivery due to our handling, contact us immediately.

Delivery fee refunds and re-delivery charges in failed delivery situations are assessed in accordance with our Return & Refund Policy and these Terms.

9. Health and Accessibility

We are committed to making our products accessible. If you require special delivery arrangements due to health conditions or mobility limitations, please notify us at the time of purchase in the order comments section. We will make reasonable efforts to accommodate your needs.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law.

10. Our Online Store & Pick-Up

Products are added regularly to our website. Factory pick-up is available by appointment only. To schedule a pick-up, please contact us at least 24 hours in advance.

11. Acceptance and Rejection of Orders

We reserve the right to accept or reject any order for reasons including unavailability of product, pricing or technical errors, suspected fraud, payment issues, or breach of these Terms.

12. Minimum Orders & Fees

The following charges apply based on your delivery location. All fees are calculated at checkout.

Handling Fee: Any handling fee charged at checkout is generally non-refundable. However, the handling fee may be refunded where the order is completely wrong, defective, or the issue was caused by our fault.

Delivery Fee (Failed Delivery / Customer Unavailable): Delivery fees are generally non-refundable where delivery cannot be completed due to customer-related reasons, including customer unavailability, no suitable safe/cool place to leave perishable goods, no response to delivery calls/messages, or incorrect/incomplete delivery details. If the failed delivery is caused by our fault, we may refund the delivery fee or arrange re-delivery at no extra charge.

GST: All fees shown at checkout (including delivery and handling fees) are inclusive of GST where applicable. Any GST charged will be shown at checkout and/or on your tax invoice.

We reserve the right to adjust minimum order values or fees from time to time, including by updating pricing on the Site and/or publishing an updated fee schedule.

13. Collection of Products

You agree to comply with all collection requirements, including providing photographic identification and presenting the payment card if reasonably requested for verification. We reserve the right to cancel or delay release of orders where identity verification requirements are not met.

14. Risk and Title

The risk of loss or damage passes to you upon delivery or collection. Title / ownership passes to you only after full payment is received and delivery or collection has occurred.

15. Cancellation of an Order

Frozberries may cancel any order at any time if products are unavailable, pricing errors occur, fraud is suspected, or these Terms are breached. If we cancel an order for these reasons, you will receive a refund for amounts paid for unavailable or cancelled items.

If you cancel an order after it has been packed or dispatched, a cancellation fee of $20 plus any reasonable costs relating to perishable product handling or loss may apply. This clause does not affect any rights or remedies you may have under the Australian Consumer Law where the cancellation relates to faulty goods, goods not as described, or another issue caused by our fault.

16-22. Liability, Privacy & Intellectual Property

Liability: To the extent permitted by law, Frozberries’ liability is limited to re-supplying the products or refunding the purchase price. Nothing in these Terms excludes or limits any non-excludable rights or remedies under the Australian Consumer Law.

Privacy: We collect and use personal data in accordance with our Privacy Policy.

Intellectual Property: All site content, logos, designs, images, text, and other materials are the property of Frozberries (or its licensors). Reproduction, reuse, or distribution without permission is prohibited.

23. Dispute Resolution

If you have a complaint, please contact us first so we can attempt to resolve the issue promptly and fairly. Disputes not resolved directly may be referred to the relevant state or territory consumer protection authority.

24-25. Legal Framework

These Terms are governed by the laws of New South Wales, Australia. If any provision is found invalid or unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and Frozberries in relation to the Site and purchases made through it, except where otherwise required by law.
